The Actual Will of the People Means Nothing
The 9th U.S. Circuit Court of Appeals ruled that the historic vote cannot proceed as scheduled because some votes would be cast using outmoded punch-card ballot machines. The decision applies to all the recall questions on the ballot, as well as two propositions.
You can read the whole story here. But first off a point or two.
In a stunning display, the 9th Circuit Court of Appeals shows just why they are the most frequently overturned federal appeals court in the country. Also, one wonders if this recall was to oust President Bush would the ACLU be so quick to run to Court? As Lee over on Right Thinking likes to say, the mind boggles.
I don't have a dog in this fight, but still I would like to see this thing get before SCOTUS before the ink is even dry on the appeal so that the objective will of the people of California can be honored.
